KOKOINDIA HOLIDAYS : TERMS AND CONDITIONS

All of the travel services and products detailed in this website are sold subject to these Terms and Conditions, and the same shall govern the contract between KOKOindia and the client. The ‘client’ means the person or persons in whose name and/or on whose behalf the booking is made and includes every person availing the services of KOKOindia, including infants and children.

 

PAYMENT FOR INDIVIDUALLY TAILORED HOLIDAYS

Once we have agreed upon your travel route and basic itinerary, a non-refundable administrative fee of Rs 30,000 per person or a 50% deposit (inclusive of the aforementioned fee) is required before we can proceed with the more detailed planning of your holiday.

The balance payment is due no later than eight weeks prior to departure i.e. from the date the holiday is scheduled to commence, or a date thereafter we have agreed upon in writing. Some hotels may operate a policy which requests full payment in advance during peak times, in which case we will communicate this to you in good time and request a higher deposit.

Once you are ready to proceed with the booking of your holiday, we will provide the bank details for our KOKOindia accounts in India and the UK, as well as for the ethical payment company TransferWise. In clearly providing on our website and in sending you this list of Terms and Conditions, it shall be legally assumed that you have read and agreed to all of them, unless any of the content contained herein is queried in advance of making a payment.

If you wish to change any part of your booking after the full payment has been made, please let us know as soon as possible and we will do our very best to help.  If it is not possible to cancel any of your reservations, such as hotels or pre-booked transport where a specified non-refundable payment was made in advance, the customer must bear full charges. Major amendments, such as changing the dates, hotels or number of passengers travelling, may incur a fee of up to Rs 20,000.

KOKOindia will always endeavour to run its holidays as agreed. If however it becomes impossible to do so due to circumstances beyond our control, such as an act of nature or any other such unforeseeable event, alternative arrangements will be offered to the very best of our abilities. However, if these are not taken up by the client, we do not accept responsibility for any costs incurred, including airfares.

Please note that KOKOindia cannot be held responsible for any discounts or special rates made applicable to accommodation, transportation, monument fees, flights or excursions between the date of booking and the actual time of the trip. We can only proceed with the best and actual prices quoted to us at the time of booking. Please also note that travel companies are not required to provide a breakdown of costs for bespoke holidays, as per regular industry practices. Instead we will provide you with a singular quote to include all services and accommodation contained within an overall package, and no breakdown of costs for an individual itinerary will be given.

 

PASSPORTS & VISAS

*It is a condition of booking with KOKOindia that all travellers carry an up to date passport that is valid for at least the next six months and which contains at least two blank pages.

*It is a condition of booking with KOKOindia and the sole responsibility of our customers that you obtain a valid travel visa for India. You can seek help and advice at https://indianvisaonline.gov.in, but it is also a good idea to refer to your own country’s specific visa procedure for India – e.g: www.vfsglobal.com/India/UK

*It is a condition of booking with KOKOindia that you take out a comprehensive Travel Insurance Policy that includes sufficient cover regarding cancellation, curtailment, theft, accident, repatriation, medical, third party, liability for injury and death to others, and loss or damage to equipment. You should secure your insurance cover at the earliest opportunity to ensure you are covered, and in any event prior to departure or within 14 days of payment of the full invoice. Should this not be taken up, KOKOindia bears not responsibility for our clients’ medical etc insurance claims.

*Please note that it is your personal and sole responsibility to ensure that these documents are in good order and that you have them with you whenever necessary or upon request.

 

LIABILITY

KOKOindia accepts no liability whatsoever for any loss, consequential loss, theft, damage, personal injury, accidents, illness or death that may occur from natural disasters, industrial disputes, reason of threat or war, riots, civil strife, terrorist activities, technical problems to transport, extreme weather conditions, closure of airports and railway stations, or any other similar event due to unusual and unforeseeable circumstances beyond our control which may occur to the clients or any person associated with the clients whilst taking part in a KOKOindia holiday.

KOKOindia does not accept responsibility and is no way liable for any negligent acts or defaults of any supplier or any other person, company or corporation not directly under its control. KOKOindia does not own or control any of the hotels, ground handlers or other providers of services or facilities that we book or recommend; or any air or sea common carriers whose individual conditions of carriage apply; or any other facilities mentioned in your holiday itinerary.

As an operator of your holiday package therefore, we cannot be held liable.
  • Where there has been no fault on the part of the company, supplier or agents.
  • Where the failures in performance of the contract are attributable to the customer.
  • Where the failures are attributable to a third party not connected with the provision of the holiday and is unforeseeable or unavoidable.
  • Where the failures are due to unusual and unforeseeable circumstances beyond our control.
  • Where the failures are due to an event which you or your supplier even with all due care could not foresee or foretell.
  • Where any act, omission, default of any independent contractor or other person or by any servant or agents employed by them who may be engaged or concerned in the provision of accommodation, refreshment, transport or service for the clients howsoever caused.

It is extremely important that you notify us in advance if you have any significant and pre-existing medical condition that could affect your holiday or if a medical condition changes or develops once you have embarked on your trip. In this way, KOKOindia can take every step to ensure that our clients are not stretched beyond the limit of their capabilities, but we also ask that you inform your guide, safari leader or relevant KOKOindia representative if you have any particular pre-existing injury or illness that could affect your health during your trip. Equally, if you are finding any activity too difficult, please notify the relevant KOKOindia representative with you immediately.

We take all reasonable steps in ensuring that the highest standards are maintained and that we provide a service that is acceptable to our customers. The information within this website has been compiled with all due reasonable care, is correct to the best knowledge of the company and is published in good faith.

 

EARLY CHECK-INS & LATE CHECK OUTS

KOKOindia will always endeavour to arrange for a convenient check-in and check-out time for you but please note this is the independent policy and decision of each hotel and s such we are unable to offer a guarantee. Any additional fee charged by a hotel for an early check-in or late check-out is not included in the cost of your holiday, but we will notify you in advance if such a charge is pending. If you require a late check-out subsequent to the confirmation of your itinerary, it is the sole responsibility of our customers to arrange that directly with the hotel.

 

EXTRA USE OF OUR VEHICLES

Please note that your itinerary will clearly state what is included in terms of the usage of our vehicles. KOKOindia takes every step to ensure the personal safety of our customers and respect for the safety of our drivers in terms of a safe number of driving hours.  Therefore, and unless otherwise stated in your itinerary, the cost of your holiday does not include extra usage of our vehicles – unless this is amicably agreed with the consent of the driver or by direct confirmation with one of the KOKOindia team.

SURCHARGE

The cost of your travel arrangement is subject to surcharges in case of a sudden hike in fuel prices, scheduled airfares or any taxes levied by the government. Where a holiday is confirmed quite far in advance, KOKOindia will always advise you of this and may charge you accordingly with a refund of any excess amount guaranteed. As a gesture of goodwill, we will always try to absorb a small percentage of any surcharges, but any amount exceeding 5% will be surcharged to our customers.

 

DESCRIPTION OF SERVICES WITHIN AN ITINERARY

Your confirmed KOKOindia itinerary describes the then available services as accurately as possible. However, factors and circumstances beyond our control like traffic problems, weather conditions, fairs, festivals, sport events, political/religious gatherings, strikes, change of management/closure of hotels/restaurants, overbooking of hotels/flights, cancellation/ re-routing of flights or railway, closure of / restricted entry at a place of sightseeing may result in changes in the itinerary. We therefore, reserve the absolute right to alter, amend, change or modify the itinerary, schedule, travel plans and sightseeing if necessary. Where we may know of any such changes sufficiently in advance you will be notified by your KOKOindia representative as soon as possible – otherwise our KOKOindia representative will inform you of the changes on the spot.

COMPLAINTS

In the highly unlikely event that you have any complaints about any of our operators or services, we will do our very best to assist you in resolving them.  If however your complaint cannot be corrected by informing the appropriate KOKOindia representative at the time, we ask that you advise us of the complaint in detail by writing to [email protected].

This must be carried out no later than fourteen days after the completion of your holiday, after which time we regret that your complaint cannot be dealt with. Failure to notify KOKOindia of any grievance at the time will absolve the company of all responsibility in the settlement of any subsequent related claim once you have returned.
